Germius Technologies L.L.C-FZ (“Germius Technologies”, “we”, “us” or “our”), with registered address at Meydan Grandstand, 6th Floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E., is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you use our website (germiustechnologies.com) and related services. It also describes your rights regarding your personal data under applicable laws such as Dubai’s data protection regulations, the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA). By using our website, you agree to the collection and use of information in accordance with this Privacy Policy. We encourage you to read this Policy carefully. If you do not agree with any part of it, please discontinue use of our services.
Information We Collect
We collect several categories of personal data through our site and interactions with you. The types of information we may collect include:
- Contact Information: Such as your name, email address, telephone number, company name, and mailing address. For example, we collect this information when you fill out forms (like a contact or sign-up form) or register an account on our site.
- Account and Login Information: If you create an account, we may collect login credentials (such as username and password) and any profile details associated with your account.
- Communication Data: Any information you provide when contacting us directly. This includes the content of emails or messages you send to us, subject matter of inquiries, and any attachments or additional contact details you choose to provide.
- Transaction and Order Information: If you make a purchase or engage our services, we collect information related to your orders. This may include details about the products or services requested, payment information (such as billing address, payment method details, or transaction IDs), and any necessary information to process your order. (Note: We do not store full credit card numbers on our servers — any payment processing is handled via compliant third-party processors.)
- Usage and Technical Information: When you visit our website, we automatically collect certain information about your device and how you interact with our site. This can include your IP address, browser type and version, device identifiers, operating system, referring webpage, pages you viewed, the dates/times of visits, and other statistics. We gather this data through server logs and analytics tools in order to understand usage patterns. This information helps us troubleshoot issues, analyze performance, and improve our services. (We do not use cookies or similar tracking technologies to collect personal data, and thus no cookie data is stored by us.)
- Other Information: We may receive additional personal data about you from third parties. For example, if you interact with our social media pages or login via a social network, or if a partner provides your information in connection with a joint service, we could collect identifiers or profile information from those sources. We will treat any such combined information in accordance with this Privacy Policy.
We do not knowingly collect data from children. Our website and services are not intended for individuals under the age of 18, and we do not intentionally collect personal information from anyone under 18. If you are a parent or guardian and believe your child has provided personal data to us, please contact us and we will promptly delete that information.
How We Use Your Information
We use the personal information we collect for the following purposes:
- To Manage Customer Accounts and Provide Services: We use your data to create and maintain your account, verify your identity, provide our products or services, and fulfill any contracts with you. This includes processing orders and transactions, providing customer support, and communicating with you about your account and usage of our services.
- For Order Processing and Service Delivery: Your information is used to process your purchases or service requests, arrange payments (through secure third-party payment processors), deliver digital products or services, send order confirmations and invoices, and manage any related logistics.
- Marketing and Communications: We may use your contact information to send you newsletters, updates, marketing communications or promotions about our products and solutions that may interest you. We also use it to respond to your inquiries, messages, or feedback. You can opt-out of marketing emails at any time by clicking the unsubscribe link in the message or contacting us directly. We will not send you marketing communications if you ask us not to.
- Analytics and Service Improvement: We process usage and technical data to understand how our website and services are used. This helps us analyze trends, track the effectiveness of features or campaigns, and improve our offerings and user experience. For instance, we analyze which pages are most visited or how users navigate our site so we can make enhancements. We may also use aggregated data to develop new features or services and to improve performance.
- Legal Compliance and Protection: We may use personal information as necessary to comply with applicable laws and regulations of Dubai, the United Arab Emirates, or other jurisdictions. This includes using data to fulfill legal obligations (such as record-keeping or reporting requirements), respond to lawful requests by public authorities, or as required in judicial proceedings. We also may process data to enforce our Terms and Conditions, protect our rights, privacy, safety or property, and that of our customers or others, and to detect, prevent, or address fraud, security, or technical issues.
- Other Legitimate Business Purposes: We may use your information for other legitimate interests, such as internal audits, developing new products, training, or ensuring the security of our operations. If we process your personal data for a purpose beyond the original purpose of collection, we will ensure it is compatible with the original purposes or obtain your consent.
We will only use your personal information for the purposes described above or as otherwise disclosed to you at the time of collection. If we need to use your data for an unrelated purpose, we will notify you and obtain your consent when required by law.
Sharing Your Information with Third Parties
We do not sell or rent your personal information. However, in the course of running our business, we may share your personal data with third parties in certain situations, as described below. Whenever we share data, we ensure that the recipients are bound to protect your information and to use it only for the purposes we authorize.
- Service Providers: We share personal information with trusted third-party service providers who perform services on our behalf. For example, we may use cloud hosting providers to store data, payment processors to handle billing transactions, analytics companies to analyze website usage, email service providers to send communications, or marketing partners to assist in our campaigns. These service providers are given only the information necessary to perform their functions and are contractually obligated to protect your data and use it only for our specified purposes.
- Business Partners and Affiliates: We may share information with our affiliated companies (such as any subsidiaries or companies under common ownership) or business partners if necessary for operating the website or providing services you requested. For instance, if we collaborate with a partner to offer a joint product or promotion, we might need to share relevant customer information. Any such partners will be required to uphold privacy protections comparable to ours.
- Legal Requirements and Protecting Rights: We may disclose your personal information if required to do so by law or in response to valid legal requests (e.g., subpoenas, court orders, or government regulations). We may also share information when we believe it is necessary to investigate, prevent, or act regarding suspected illegal activities, fraud, situations involving potential threats to the safety of any person, or violations of our terms or this Privacy Policy. In such cases, we will only share the data that is reasonably necessary for the specific purpose.
- Business Transfers: If Germius Technologies is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred as part of that transaction. Should such a transfer occur, we will ensure the recipient of the personal data commits to privacy measures at least as protective as those described in this Policy, and we will provide notice to users before personal data becomes subject to a different privacy policy.
- With Your Consent: In situations where you specifically consent to or request information sharing, we will share your data accordingly. For example, if you ask us to introduce you to a partner company or if you opt-in to an event where data is shared with sponsors, we will transfer your information with your knowledge.
International Data Transfers: The third parties with whom we share personal data may be located in countries outside of your own, including countries that may not provide the same level of data protection as your home jurisdiction. For example, if you are in the European Economic Area (EEA), information we collect from you may be transferred to and processed in the United Arab Emirates or other countries. We take steps to ensure that appropriate safeguards are in place when transferring data internationally. These may include reliance on the European Commission’s approved standard contractual clauses or other lawful mechanisms to ensure your personal information remains protected according to GDPR standards even when processed in other countries.
Please note that any third-party websites that may be linked through our site (for example, external services or partner sites) are not operated by Germius Technologies and are outside the scope of this Privacy Policy. We have no control over how third-party sites handle your data. If you click on a link to another website, we encourage you to review the privacy policy of that site separately.
Data Security
We take the security of your personal information seriously. Germius Technologies implements a variety of administrative, technical, and physical security measures to safeguard the data we collect against unauthorized access, alteration, disclosure, or destruction. For example, information is stored on secure servers in facilities with high levels of protection. We use encryption and security protocols where appropriate, and we limit access to personal data to authorized employees or contractors who need it to perform their job duties. These authorized personnel are required to keep information confidential.
While we strive to protect your information through stringent security standards and regularly review our practices to prevent vulnerabilities, no method of transmission over the internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your data. In the unlikely event of a data breach that affects your personal information, we will notify you and the relevant authorities as required by law.
Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. For example, if you are a customer, we will keep your account and transaction data for as long as your account is active or as needed to provide you with services. We may also retain certain information afterward to comply with laws (such as financial record-keeping), resolve disputes, or enforce our agreements.
When personal information is no longer required for the purpose it was collected, or upon your valid request (see Your Rights below), we will either securely delete the information or anonymize it so that it can no longer be associated with you.
Your Privacy Rights
Depending on your jurisdiction and the applicable data protection law, you have certain rights regarding your personal data. Germius Technologies is committed to honoring your rights and ensuring you can exercise them. The availability of these rights and the ways to exercise them can vary between the GDPR (for EEA residents) and the CCPA (for California residents). Below, we outline rights under each of these laws.
Rights Under the GDPR (For EU/EEA Residents)
If you are located in the European Union, European Economic Area, or a jurisdiction with similar data protection laws, you have the following rights concerning your personal data:
- Right of Access: You have the right to request confirmation of whether we are processing your personal information and, if so, to ask for a copy of the data we hold about you. We will provide you with a summary of the personal data we have, along with details on how we use it and who we share it with, subject to any legal restrictions.
- Right to Rectification: If any of your personal information is inaccurate or incomplete, you have the right to ask us to correct or update it. We encourage you to keep your information up-to-date and will promptly make corrections upon verification of the new information.
- Right to Erasure (Right to be Forgotten): You may request that we delete or remove your personal data when it is no longer necessary for the purposes it was collected, or if you believe it is being processed unlawfully. We will honor valid deletion requests, provided there is no legal obligation or overriding legitimate interest for us to retain the data (for example, we might need to keep certain records to comply with financial regulations or legal claims).
- Right to Restrict Processing: You have the right to ask us to limit or “pause” the processing of your personal data in certain circumstances. For instance, if you contest the accuracy of your data, you can request we restrict processing until the accuracy is verified. Similarly, if you object to our processing (see below), you can request restriction while we consider your objection. When processing is restricted, we will still store your information but not use it further until the restriction is lifted.
- Right to Object: You can object to our processing of your personal information when that processing is based on our legitimate interests (or those of a third party) and you believe it impacts your fundamental rights and freedoms. You also have the absolute right to object to your personal data being used for direct marketing purposes. If you lodge an objection, we will evaluate whether our legitimate grounds for processing override your rights or if we must stop processing your data. In the case of marketing objections, we will cease using your data for such marketing purposes upon your request.
- Right to Data Portability: You have the right to request a copy of certain personal data in a machine-readable, commonly used format (for example, a CSV file), and/or to request that we transfer this information to another data controller where technically feasible. This right applies to personal data that you provided to us and that we process by automated means based on your consent or in performance of a contract.
- Right to Withdraw Consent: Where we rely on your consent to process personal data (for example, if you gave consent to receive marketing emails), you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, and it will not affect processing of your data under other legal bases (such as processing necessary for fulfilling a contract or complying with a legal obligation). If you withdraw consent for marketing, we will stop sending you marketing communications.
- Right to Complain to a Supervisory Authority: If you believe that our handling of your personal data infringes applicable data protection laws, you have the right to lodge a complaint with a data protection supervisory authority. You may do so in the EU member state where you reside, where you work, or where the alleged infringement occurred. For instance, if you are in the EU, you can contact the data protection authority in your country (a list of EU authorities is available online). We would, however, appreciate the chance to address your concerns directly before you approach a regulator, so we encourage you to contact us first with any complaint.
Exercising Your GDPR Rights: You can exercise any of these rights by contacting us using the contact details provided in the Contact Us section below (for example, by emailing our Data Protection Officer at dpo@germiustechnologies.com). We may need to verify your identity and request before fulfilling certain requests (to ensure we don’t disclose data to the wrong person). We will respond to your request as soon as possible and within the timeframe permitted by the GDPR (generally within one month, with the possibility to extend by two further months in certain complex cases). If we cannot fulfill your request, we will explain the reasons in our response.
Rights Under the CCPA (For California Residents)
If you are a resident of California, the California Consumer Privacy Act (CCPA) provides you with specific rights regarding your personal information. In accordance with the CCPA (as amended by the California Privacy Rights Act, where applicable), California consumers have the right to:
- Know What Personal Information is Collected and Shared: You have the right to request that we disclose the categories of personal information we have collected about you, the categories of sources of that information, the business or commercial purposes for collecting it, and the categories of third parties with whom we share personal information. You also have the right to request the specific pieces of personal information that we have collected about you over the past 12 months.
- Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions. Once we receive and confirm a verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. Exceptions may include, for example, if the information is necessary to complete a transaction you requested, to detect security incidents, to comply with a legal obligation, or other CCPA-permitted purposes.
- Right to Opt-Out of Sale or Sharing of Personal Information: The CCPA gives you the right to direct businesses not to sell your personal information to third parties. Germius Technologies does not sell personal information to third parties for monetary value. We also do not share personal information for cross-context behavioral advertising without consent. If we ever engage in practices that qualify as a "sale" or certain types of "sharing" under CCPA/CPRA, we will provide a clear opt-out mechanism (such as a “Do Not Sell or Share My Personal Information” link on our website). In any case, you have the right to opt out of any sale of your data.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means that, for instance, we will not deny you goods or services, charge you a different price, or provide a different level of quality of services just because you exercised your rights under the CCPA. However, please note that if you request deletion of certain data, we may not be able to provide services that rely on that information (for example, we can’t maintain your account if we delete all of your account data).
Exercising Your CCPA Rights: To exercise the access (knowledge) or deletion rights described above, please submit a verifiable consumer request to us by contacting us at dpo@germiustechnologies.com or contactus@germiustechnologies.com with the subject line “CCPA Request”. In your request, please provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (or an authorized representative of that person) and describe your request with sufficient detail for us to properly understand and respond. We may need to ask for additional information to verify your identity (such as confirming specific details we already have on record). We will respond to your request within the timeframe required by CCPA (generally within 45 days, with an extension of an additional 45 days if reasonably necessary with notice to you).
If you are an authorized agent making a request on behalf of a California consumer, we may require proof of your authorization and still directly verify the consumer as required by law. Any personal information collected from you in connection with a CCPA request will be used solely for the purposes of verification and fulfilling your request.
